1. Roles and eligibility

Brand My Bike provides an online intermediation service. This is paid advertising inventory, not a donation. The rider supplies physical sponsor placement on a specified bike; the sponsor purchases that service. Riders may register as an individual, sole trader or company but are treated as potentially reportable sellers/service providers regardless of that label. Sponsors act through verified organisations. Users must be at least 18 and authorised to contract. Each country remains disabled until its legal and tax policy is approved.

2. Account and verification

Email confirmation, role-specific details and acceptance of the current terms and privacy version are required. Identity, payout, business, trademark and sanctions/fraud checks may be required before publication or bidding. Verification is not an endorsement of performance.

3. Auction mechanics and bike goal

Each physical position has a minimum bid and increment. The rider chooses 3, 7 or 14 days. A bid in the final ten minutes can extend closing by ten minutes, at most six times. The displayed goal is only the frozen, verified dealer price of the exact bike. Only current leading bid principals count. If they do not reach the goal at close, the entire auction fails; the rider cannot privately fill a gap and no partial financing occurs.

4. Deposits, winner payment and fees

A bid immediately charges a 20% deposit, at least €25 but never more than the bid. Raising one’s own leading bid charges only the deposit difference. An outbid deposit is refunded in full. On target failure, all remaining deposits are refunded. Winners have 48 hours to pay their remaining principal plus a 12% sponsor service fee, disclosed print cost and applicable tax. A failed winner may be replaced by the next bidder for 24 hours. If the resulting paid principal falls below the bike goal, all collected amounts are reversed. Stripe Connect uses separate charges and transfers; Brand My Bike does not provide or describe this as escrow.

5. Bike procurement and sponsorship term

After every required winner payment succeeds, the verified bike is bought preferably by controlled payment to the dealer. Alternatively, an already paid rider purchase can be reimbursed only after invoice review. No unrestricted advance payout is offered. If the exact bike is unavailable, an equal-or-better replacement requires every winner’s consent or all amounts are refunded. Brand assets pass central review and print. Each placement starts only when the mounted sticker photo is approved and ends exactly 365 days later.

6. Performance, products, cancellation and disputes

The rider owes the approved physical placement, not a kilometre, reach, impression, click, sale or return guarantee. Defect, theft or ordinary inability to ride does not pause the term; intentional removal or false proof may breach the agreement. Sponsors can attach at most three moderated active products to each active placement, automatically archived at term end. Failed procurement, unlawful creative, payment failure, non-delivery, disputes and replacement-bike refusal follow documented all-party refund and human-review procedures before launch.

7. Ranking and marketplace access

Discover ranking is intended to use location match, discipline, verified recent activity, available inventory, campaign completeness and freshness. Paid ranking must be clearly labelled. Restrictions, suspension and termination require reasons, a review route and, where applicable, notice on a durable medium.

8. Content and intellectual property

Users retain their content and grant the platform only the licence necessary to host, display, moderate and market the relevant profile or campaign. Sponsors warrant rights to submitted marks. Rider and sponsor content may not imply an unapproved partnership. Platform branding and software remain protected.

9. Data access and export

Users can access their own account, campaign, bid, payment-status and performance data and request a machine-readable export or account deletion from the account area. Public fields remain available while published. Active obligations must be resolved first, and contract, tax, fraud and audit records may remain after termination for legally required periods.

10. Taxes and platform reporting

Riders remain responsible for their own registration, invoicing, VAT and income obligations unless applicable law assigns a duty to the platform. Brand My Bike may need to collect and verify seller identification and consideration data and report it under DAC7 or national implementation. This must be configured for the operator’s Member State before payouts.

11. Liability, law and complaints

Mandatory liability cannot be excluded. Any contractual limits, governing law, courts, complaint process, mediation and regulator contacts depend on the operator’s establishment and user classification and are intentionally not invented here.
